Iowa Supreme Court Declares Gay Marriage Ban Unconstitutional

A victory for tolerance and separation of church and state, Iowa is now the 3rd state where Gay marriage is legal.

(DES MOINES, Iowa) — The Iowa Supreme Court says the state's same-sex marriage ban violates the constitutional rights of gay and lesbian couples, making it the third state where gay marriage is legal.

In a unanimous ruling issued Friday, the court upheld a 2007 Polk County District Court judge's ruling that the law violated the state constitution. (See pictures of people in Madrid celebrating the legalizing of gay marriage.)

The case stems from a 2005 lawsuit filed by Lambda Legal, a New York-based gay rights organization. The group filed a lawsuit on behalf of six gay and lesbian Iowa couples who were denied marriage licenses.

The suit named then-Polk County recorder and registrar Timothy Brien.

The Polk County attorney's office claimed that Hanson's ruling violated the separation of powers and the issue should be left to the Legislature.

Iowa.... Iowa? Nice to have the Bible belt as a leading state on this issue. Wait, are we tying the homo agenda to atheism? Good, then they can support our fight for recognition too. Human Rights for all!

Well, I've never met an atheist that doesn't support gay rights. Probably because we don't live by the creed of a bronze age novel that says they're evil abominations. I also think atheists/gays are so supportive of each other also because we are the only 2 groups in the nation that are openly and (in the public eye) acceptably descriminated against on a regular basis.

I didn't post this here for that reason though, I posted it because a) I post a lot of political stuff on my blog and b) I know there are a *LOT* of people here, gay and straight, that support the gay rights movement.
